Fair Usage Policy

This Fair Usage Policy applies to the text-to-image generation feature ("Image Generation") offered within LMSA: Chat with LM Studio ("App"), provided by TechMitten LLC ("we", "us", or "our").

LMSA offers unlimited text-to-image generation to Premium users. "Unlimited" means there is no fixed cap on the number of images you can generate. However, this is subject to the fair usage guidelines described below. By using the Image Generation feature, you agree to this Fair Usage Policy. Your use of LMSA is also governed by our Terms of Service and Privacy Policy.

1. Purpose

The Fair Usage Policy exists to ensure that Image Generation resources are distributed equitably across all users. It prevents individual users from monopolizing shared infrastructure — including compute capacity, API quotas, and network bandwidth — so that everyone continues to receive a reliable and responsive experience.

2. What "Unlimited" Means

"Unlimited" text-to-image generation means:

  • There is no hard monthly cap on the number of images you may generate.
  • You are not required to purchase additional credits or tokens to keep generating images.
  • Normal, personal, and creative use will never be throttled or restricted.

3. Fair Use Guidelines

While there is no fixed limit, we expect users to use Image Generation for legitimate personal or professional creative purposes. The following activities are considered outside the scope of fair use:

  • Automated or scripted batch generation (bots, scripts, macros)
  • Reselling generated images as a service or stock content
  • Using Image Generation to flood, spam, or abuse any platform
  • Generating content that violates our Terms of Service
  • Sharing accounts to pool image generation capacity
  • Generating images at sustained high volumes that far exceed typical user patterns
  • Attempting to circumvent rate-limiting or abuse-prevention mechanisms
  • Using Image Generation for cryptocurrency minting at scale

4. Rate Limiting and Traffic Management

To protect service quality for all users, we employ dynamic rate-limiting and traffic-management measures:

  • Soft limits: If your usage significantly exceeds typical user patterns over a sustained period, you may experience slower response times or temporary queuing for image generation requests.
  • Cooldown periods: In cases of unusually high-volume usage, the App may introduce short cooldown periods between generation requests to allow infrastructure resources to stabilize.
  • No hard caps: These measures are designed to manage traffic, not to cut off access. You will always be able to continue generating images, though there may be brief delays during peak demand.

5. Monitoring and Enforcement

We monitor aggregate usage patterns to maintain service quality. If we detect usage that substantially deviates from normal patterns, we may:

  • Apply temporary rate limits to your account.
  • Display an in-app notification explaining the limitation and when normal speeds will resume.
  • Contact you to discuss your use case and explore solutions.

We will make reasonable efforts to notify affected users before applying any restrictions. Persistent or egregious abuse of the service may result in suspension of Image Generation access or, in extreme cases, termination of your account in accordance with our Terms of Service.

6. Acceptable Content

All images generated through LMSA must comply with our Terms of Service, including the Prohibited Uses outlined in Section 4. In particular, you may not use Image Generation to create:

  • Illegal, harmful, threatening, abusive, or defamatory content.
  • Content that infringes on the intellectual property or privacy rights of others.
  • Explicit, non-consensual, or exploitative material.
  • Content intended to deceive, defraud, or mislead (e.g., deepfakes of real individuals without consent).
  • Content that promotes violence, self-harm, or hate speech.

7. Third-Party Model Providers

Image Generation relies on third-party AI model providers and infrastructure. Their availability, performance, and content policies may affect the Image Generation feature. TechMitten LLC does not guarantee uninterrupted access and is not responsible for temporary outages, model changes, or content filtering applied by third-party providers. Usage through third-party backends (such as OpenRouter) is also subject to those providers' respective terms of service.

8. Changes to This Policy

We may update this Fair Usage Policy from time to time to reflect changes in the service, technology, or usage patterns. Material changes will be communicated through in-app notifications or on our website. Continued use of Image Generation after any changes constitutes acceptance of the revised policy.
